This Privacy Policy is made in fulfillment of the obligations of MKAFINANCE LTD / hereinafter referred to as MKA and / or We / in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) of the European Parliament and of the Council of 27 April 2016 and the Personal Data Protection Act.

 

The policy is informative and aims to explain what personal data the MKA collects, for what purpose, on what legal basis, how it processes and stores them, and when it is necessary to disclose personal data to third parties. This policy also provides information on the rights that subjects have in relation to the processing of their personal data and the applied technical and organizational measures for protection against them.

Information we collect about you and why?

We collect personal data about you for the purposes of our services, such as accounting services, preparation of salaries, payroll, VAT returns, annual closing and consultations.

Most often we process data of:

  • Owners and managers of companies that are our customers;
  • Employees, contractors and clients of the companies that are our clients;
  • Individuals who enter into relationships with us.

 

In most cases, we require your personal data for the purposes of concluding and executing a contract, to comply with a legal obligation or to protect our legitimate interest. Without this data, we would not be able to provide the relevant services. If you do not provide us with credentials, we will not be able to provide you with the relevant service. Depending on the services you use, we may collect and process the following information about you:

 

When providing accounting services and salary processing

  • Names, PINs and ID card data;
  • Address;
  • Work experience data;
  • Bank details;
  • email address and phone;
  • As well as other data that we may receive from you when providing accounting services.

 

When preparing documentation related to the company

  • Names, and PIN;
  • Address;
  • Data of proxies, in the presence of representation;
  • As well as other data that we may receive from you when preparing the documentation.

 

When contacting us

  • Names;
  • Email address.

 

On what basis do we process your personal data?

We may process your personal data alternatively, based on any of the following grounds, namely:

  • Conclusion or performance of a contract;
  • Your unequivocal consent to the processing of your personal data, expressed through actions to send the data and their confirmation;
  • Our legitimate interest in establishing, exercising and defending our rights in connection with a potential or arising dispute;
  • Fulfillment of a legal obligation – in connection with tax or other legislation.

 

For what purposes will we use your data?

We need your personal data in order to be able to:

  • contact you when performing the relevant services;
  • to conclude a contract for accounting services;

The personal data we collect from you will only be used for the purposes for which it has been announced that it is being collected.

 The security of the data you have entrusted to us is very important to us. That is why we protect your data by applying all appropriate technical and organizational means at our disposal to prevent unauthorized access, unauthorized or malicious use, loss or premature deletion of information.

MKA takes measures to protect your personal data from accidental loss and unauthorized access, use, alteration or disclosure. There are policies and procedures designed to protect information from loss, misuse and unauthorized disclosure.   • IT service providers who are responsible for the maintenance of used hardware and software for data storage and processing.
  • External consultants who provide services in the field of legal and accounting services.
  • State or municipal bodies or other organizations with public functions that may receive information on the basis of legal powers to request and receive such information, as well as other state bodies in the cases provided by law, in connection with the performance of legal obligations or in connection with court proceedings.

 

For how long do we store your personal data?

Your personal data will be stored for the period necessary to fulfill the purposes described above, but not more than 5 years, unless the law requires us to keep the data for a longer period. However, in the event of a legal or other dispute, we may retain your personal information for 5 years or until it is finally resolved.

Part of the statutory storage periods are:

  • 50 years for payrolls;
  • 10 years for accounting information, etc.

 

Your rights with regard to your personal data

You can exercise all the rights provided by law related to personal data, namely:

  • to access your personal data that we process and receive a copy of them;
  • your personal data to be corrected in case of inaccuracy or when the data is incomplete;
  • request that your data be deleted when the conditions for doing so are met;
  • in the cases specified by law to require the processing of your personal data to be limited;
  • in the cases specified by law to object to the processing of your personal data;
  • exercise your right to data portability and request that your data be provided in a structured, widely used and machine-readable format;
  • when the processing is carried out on the basis of your consent, to withdraw the given consent at any time and without paying any fees
  • to file a complaint to the Commission for Personal Data Protection
  • to withdraw the given consent when the processing of your personal data is based of consent.

We do our best to keep your data up to date. However, if you notice incorrect data or other irregularities, you may correct, update, change, delete or exercise any other right by contacting us at MKA. We will respond to your request as soon as possible, usually no later than 30 days after receipt.

 

How to exercise them?

 Each of the rights provided by law may be exercised by submitting a request to exercise the respective right. A request for exercising the rights of personal data subjects may be submitted as follows:

We may request the provision of additional information necessary to verify your identity when there are concerns about the identity of the individual making the request. When exercising your rights through a proxy, we should be provided with a notarized power of attorney.
